All insurance policies have claims conditions which must be complied with and full details are included within each of the policy documents.
A summary of some key claims responsibilities are noted below.
Liability incident
You must comply with the following conditions. If you fail to do so the insurer may not pay your claim or any payment could be reduced. It is your responsibility to prove any loss and therefore we may ask you to provide any relevant information, documents and assistance we may require to help with your claim. You must:
Give notice in writing to insurers via Howden as soon as reasonably practicable of the discovery of any occurrence or circumstance which may give rise to a claim under this policy
Notify Howden as soon as possible giving full details of what has happened
Comply with any reasonable request made by insurers for information relating to any claim
Forward to Howden as soon as possible, but no later than fourteen (14) days, if a claim for liability is made against you, any letter claim summons or other legal document and any related correspondence you receive unanswered. Abuse, Professional Indemnity, Management Liability, Directors and Officers and Corporate Legal Liability claims must be notified within the same period of insurance you become aware of the incident.
Inform insurers as soon as reasonable practicable of the notice of any impending prosecution or inquest which may give rise to a claim under the policy and comply with any reasonable request made by insurers
Not admit liability or offer or promise or agree to settle any claim without the insurers' written permission
- Take all reasonable care to limit any loss, damage or injury.
In the event of claim or allegation regarding abuse or a matter which may trigger your safeguarding policy please see the guidance provided here.
Personal Accident incident
Please note that if medical treatment has been received you must obtain medical certificates showing the nature of the bodily injury.
All circumstances that are likely to give rise to a claim under the Personal Accident insurance should be notified within 30 days after the occurrence (or as soon as practicably possible thereafter).
Property incident
If an event giving rise to a claim under the Insurance occurs, your responsibilities following a claim are to:
Notify the police within 24 hours of the discovery of any incident arising from malicious persons, theft or attempted theft and damage money by any cause
Notify immediately and submit full written details no later than 7 days after the date of loss for any claim in respect of riot, civil commotion, strikers or locked-out workers
Notify within 30 days of any other incident occurring (or such further time insurers may allow in writing) to provide insurers with written details
Provide insurers with all proofs and information in relation to a claim that they may reasonably require together with (if required) a statutory declaration of the truth of the claim and any connected matters;
- Take immediate action to minimise any further damage to the property insured and to avoid the interruption or interference with the business
