Restructuring & Insolvency

The Howden Restructuring and Insolvency team are specialist advisers dedicated to providing bespoke solutions to professional service and advisory firms assisting them to manage and transfer risk arising from restructuring assignments, estate management or dispute resolution.

We work with insolvency practitioners, accountants, solicitors, trustees, receivers, capital providers, turnaround professionals, transformation experts and government bodies to provide insurance and risk management solutions designed to meet their needs.

We are ready to help you meet your legislative and regulatory obligations, which includes, but is not limited to, the Insurance Act 2015, Health and Safety at Work etc. Act 1974 (HASAW), Insolvency Act 1986 and associated legislation.

A holistic approach to insolvency practitioners’ risk

Insolvency, Receivership and Trustees Insurance

  • Unique insurance covers for property and legal liabilities
  • Bespoke Cyber Insurance
  • Environmental Impairment Liability coverage.

We give you a breadth of protection a standard insurance provision could not.

Health and safety support
We’ll attend all premises on your behalf, in order to make a fair presentation to insurers and with particular consideration given to HASAW obligations.

Depending on the trading and occupancy status, this would involve:

  • Fire risk assessment (for all places of work, trading or not)
  • Health and safety audit and review (when the site is trading)
  • Due diligence of any pre-existing insurance programme that the insolvent entity may have had in place

From there we will provide a comprehensive report and detail specific actions required to meet your legal obligations.

If needs be, we can also approach the insurance market to fill any gaps in cover found during the audit. From there, we distil the insurer presentations, our market analysis and advice into a formal letter of recommendation.

Litigation risk insurance
Buying legal protection insurance covers your opponents’ costs and your solicitor’s disbursements for which you may be liable for as a result of bringing the legal action.

An initial premium is payable upon inception of cover, thereafter the limits of indemnity and premiums are pre-defined and staged.

For more information, see our legal protection insurance page here.

Why choose Howden?

Competent specialists
Our team of experienced insurance brokers, solicitors and claims managers are qualified to advise upon both legislative and regulatory obligations.

This includes those imposed by European and UK Law, and the requirements of licensing and regulatory professional bodies.

We analyse data to make cost efficient recommendations, presenting comparable key terms and the costs associated to all placements.

Immediate, broad cover
We can arrange immediate cover for both the assets and liabilities within the appointment, and the required bond.

Insurance cover is subject to a predefined trading business definition and/or the location of the subject or assets.

Risk site surveys
To mitigate risk, we undertake site surveys and formalise recommendations pertaining to HASAW, and other associated legislation.

Pro-rata daily premiums
Where appropriate, we can arrange pro-rata daily premiums. This enables us to offer full pro-rata refunds for any period of insurance whereby it ceases mid-term, which alternative insurance placements will not.

Helping you build a claims history
We are known for our innovation and use a cutting-edge digital platform to help you manage your firms’ risk.

Our transactional portal is a medium to collate risk, policy and claims data to enable us to build you a claims history, so that you are not treated by insurers as a one-off risk, and good claims performance can be rewarded, over time.
This portal will enable us to negotiate insurance premium rates based upon client and product risk information with the objective to create greater insurer market competition. Our aim is to assist you in recording and transforming your risk data to enable you to engage in the near future of digital insurance markets.
