New maritime decree: Strengthening the prevention of occupational risks

The DUERP, established by decree n°2001-1016 of November 5, 2001, concerns all employers with one or more employees and is mandatory from the hiring of the first employee.

The  Decree No. 2024-1165  of the 5th of December 2024 marks an important milestone in the obligations of employers in the maritime sector.

This document must be kept on each ship under the responsibility of a qualified crew member. A copy of the DUERP must be updated and kept under the conditions laid down in the Labour Code.

Personal Protective Equipment (PPE): a reinforced obligation

One of the key measures of this bill concerns the PPE of workers at sea:

The decree now requires all employers in the maritime sector to provide This translates to: EPI adapted to all of their employees Without distinction of gender. This measure is particularly important for women working at sea, whose specific needs for PPE have often been neglected until now.

The PPE provided must be designed to protect workers against the specific risks they are exposed to at sea, such as falls, projections, weather conditions, etc. They must also comply with current standards and be regularly checked and maintained.

In order to ensure optimal protection, PPE must be available in a range of sizes adapted to the morphology of each worker. This measure is essential to ensure the comfort and efficiency of the equipment.

In case of non-compliance with these obligations, the employer may face administrative and criminal sanctions.

The absence of providing personal protective equipment against the risk of drowning exposes the employer to a fine of 1500 euros. More seriously, a death resulting from a fall into the sea can engage the civil and criminal liability of the employer for gross negligence for failing to meet their safety obligations.

Not having a DUERP on board exposes the employer to a fine of the 5th class, which is 1500 euros.
