Energy production facilities are not subject to regulation, as clarified by the legislator in Ordinance 2005-658 of 8 June 2005, unless they are ancillary to a facility that is subject to regulation.

This ordinance is transcribed in the Insurance Code – Article L243-1-1:

"Roads, pedestrian structures, car parks, various networks, pipelines, lines or cables and their supports, energy transport, production, storage and distribution facilities, structures for the storage and treatment of bulk solids, fluids and liquids, telecommunications structures, uncovered sports facilities, as well as their equipment, are also excluded from the insurance obligations mentioned in the first paragraph, unless the structure or equipment is ancillary to a structure subject to these insurance obligations."
