Why do I need Public & Products Liability Insurance?

Public & Product Liability is an essential insurance product for Australian small businesses. Sometimes referred to as Broadform Liability Insurance or General Liability, it provides coverage for personal injury or property damage helps protect your legal liability to third-parties, including clients, customers and the public for injury or damage to their property, caused by your business.

While Public & Product liability insurance isn’t mandatory for most businesses, it is recommended. That’s because the unpredictable nature of accidents sometimes makes them hard to prevent and the costs of being sued can be extraordinarily high.

What's covered

A dispute between you and an employee, or your ex-employee, or prospective employee, arising from a breach or an alleged breach of:

  1. your Written Contract of Employment; or
  2. related legal rights.

Provided that you have complied with the mandatory procedures specified in the Fair Work Act 2009 (Cth) relating to the Small Business Fair Dismissal Code where that code applies.

Unlawful discrimination
Where civil proceedings are brought against an employee for unlawful discrimination and you agree to engage lawyers to assist the employee to defend the proceedings.

Criminal defence

  1. a criminal prosecution against you or an employee arising from an alleged act or omission by you or an employee that arises in connection with your business.
  2. WH&S Investigation: an Investigation by an Authority into a breach of Work Health and Safety Laws by you where employees are required to be interviewed or documents are required to be produced to the Authority.
  3. WH&S action: to the extent permitted by law, a prosecution for breach of Work Health and Safety Laws by you, or proceedings challenging improvement notices or prohibition notices served on you under Work Health and Safety Laws.
  4. WH&S enforceable undertaking: the negotiation of an enforceable undertaking by you with an Authority in respect of alleged breaches of Work Health and Safety Laws as an alternative to prosecution through the courts.

Any claim arising from or relating to:

  1. redundancy or alleged redundancy, unfair dismissal claims, or general protection claims where the circumstances giving rise to the claim occurred before this policy commenced or during the first 180 days of this policy, unless You had equivalent cover with us in force immediately before this policy commenced;
  2. legal costs & expenses for representing you at an internal disciplinary hearing, grievance or appeal;
  3. a contract for service; or
  4. any disputes or actions involving trade unions

Any claim arising from or relating to:

  1. deliberate discrimination which amounts to unlawful discrimination; or
  2. defending you

Any claim arising from or relating to:

  1. immigration;
  2. allegations of murder or manslaughter;
  3. gross negligence;
  4. recklessness; or
  5. taxes.

It is important to keep in mind that if you decide to pay your premium in monthly instalment, this will attract additional costs. 

Yes, if you decide to purchase a policy, you should then receive two emails which include: 

(a)    a record of any answers you gave to any questions; 
(b)    your certificate of currency;
(c)    your policy schedule including any relevant policy endorsements); and 
(d)    your tax invoice confirming the purchase of your selected policy(s).

A self-employed tradie or sub-contractor is responsible for their business activities while on a job site. They could cause property damage or personal injury while on the job, and this could result in being liable for financial damages.

Public & Products Liability insurance is important for all tradies who are self-employed or who are working as sub-contractors. For some tradies it is mandatory, for others it is simply a smart way of protecting their businesses.
 

This depends on the size, nature and the risks involved with running your business. You will have the option of purchasing limits of $10 million or $20 million cover. 

Yes. We extend the Public & Products Liability policy to include an endorsement that covers defect liability and trade practices liability for electricians operating in Queensland in order to comply with the insurance requirements contained in the Electrical Safety Regulation 2002.

Yes. We extend the Public & Products Liability policy to include an endorsement that covers defect liability and trade practices liability for plumbers operating in Victoria in order to comply with the insurance requirements contained in the Licensed Plumbers General Insurance Order 2002.

If one of your employees is injured at work, this policy will not cover them for the injury that they may sustain. 

If you are after a Workers’ Compensation policy which provides cover for your employees for injuries that are sustained at work, contact us on 1300 904 503.

This Public & Products Liability policy provides cover for the named insured noted on the policy. It does not extend to provide cover for sub-contractors that you engage. 

Sub-contractors that you engage should have their own public liability in place.

We offer excesses between $500 and $2,500. We recommend that you select an excess to suit your circumstances.
