How will this affect me?

Please find below the latest updates on how will this affect you as an individual / business.

  • All employers must effect a compliant Annual WIC policy starting from 1 September 2020.
     
  • You can only buy from designated insurers licensed by MOM.
     
  • The new policy wording will be very broad and contain only policy exclusions on War, Terrorism, Nuclear Asbestos, Sanctioned Countries Clause.
     
  • Common-Law Coverage is not part of the MOM Approved Wording. Insurers may offer Common Law Coverage as a separate policy or in addition to MOM Approved Wording.
     
  • Insurers will require you to disclose more information for their underwriting which will now be very thorough. Please refer to Information Required To Be Disclosed to Insurers on the information required to be provided
     
  • You may experience a higher premium in view of the broader coverage.
     

 

Project Employer’s Liability Insurance

  • For accidents that occur at the project site managed/controlled/ undertaken by Principal, there is an obligation on the Principal to deal with project-related injury by an accident of worker under Common Law and Section 13 of the WICA 2019.
     
  • The principal may be held liable and required to compensate when the insured worker is uninsured and the contractor (that is the employer of the injured worker) is insolvent.
     

 

Information Required To Be Disclosed to Insurers

  • Employers are to provide UEN No, headcount and wages of employees.
     
  • If the policy covers multiple entities/UENs, required information are to be declared by the entity.
     
  • For sole-proprietor, NRIC No. is to be furnished.
     
  • Submission of CPF Statement &/or Levy statement might be required for verification.
     
  • The insurer might require completion of WICA Proposal Form for collection of the above information.
     
  • The above information must be provided to insurers prior to policy inception.
     

 

Claims Reporting Procedure

  • Employer to report all accidents (regardless of the number of days of MCs prescribed) that occur on or after 1 September 2020.
     
  • The employer continues to make I-reporting for all claims.
     
  • As a main contractor, you can no longer purchase project-specific WIC policy that include sub-contractors of every tier. You must now buy an annual policy to cover all your own employees.
     
  • As a main contractor, you must advise your sub-contractors to purchase their own policies.
     
  • If you have an existing project-specific WIC policy, we recommend that you work with your existing insurer to terminate the WIC portion of your project policies.
     
  • You can buy Project Employer’s Liability insurance to cover common law liabilities towards Principal and Main Contractor. Such insurance is not governed by WICA.
     
  • The relevant government agencies and statutory boards will no longer require project-specific WIC policy to cover construction works.
     
  • Details on obligations of the Employers, Main Contractors and Developers can be found here.
     
  • Employees will be entitled to claim light duties for accidents occurring on or after 1 September 2020.
     
  • ‘Auto-claim’, unless employee opts out.
     
  • Doctor-switching is allowed for Permanent Incapacity (PI) assessment.
     
  • Assessed PI in six months from accident, based on current incapacity at the time of accident.
