Public Liability

Public Liability protects the club if someone is injured, or their property is damaged, and they sue the club for compensation alleging the injury or damage was because of negligence on the behalf of the club. 

Allegations usually come from members of the public, visitors to your premises, members of the club or contractors. More broadly, the club could be sued by literally anyone who believes you have caused them to be injured, or damaged their property.

The limit of indemnity is £15m for each and every claim.

Not for the majority of liability claims. The only excess on ECB-provided policies only applies to claims for damage to property or cyber crime. For these, there is an excess of the first £250 of any claim.

You are covered whilst you are undertaking the usual activities of a cricket club. This includes playing and training for cricket but also administrative, commercial and fundraising activities.

Yes, if one member causes an injury to another and they sue the club, you are protected.

Yes, the policy will provide cover for the club’s legal liability at law in respect of claims that are made for injury, loss or damage that arise out of an act of negligence on your part. The policy does not provide any form of indemnity to hirers, however, in respect of their own liability. So if the hirer is sued, the claim will be on their own insurance. It’s always good practice to enquire if the hirer has the right insurance in place. 

The abuse section of liability cover protects the club and club officers against claims relating to safeguarding matters. If a claim for compensation is made against the club or its committee following an allegation of abuse, the policy will provide protection. Please note that the policy does not provide cover for any person or entity that has committed, condoned or ignored any abuse. To ensure cover, clubs should follow the ECB Safe Hands policies and procedures.

The ECB game wide insurance cover starts when your current policy, arranged by the club, expires. You would have noted this date as part of the ECB registration and cover will commence automatically from then. You will receive communication from us prior to you cover starting, so you can be assured that cover is in place.

Most clubs will already have paid for an annual Public Liability policy and so to avoid duplication, that policy should run its course until renewal.

In many cases, if you cancel your policy you will not get a refund of what you‘ve paid for that cover. So it is best to make use of it until it expires.

NB if your current liability policy is with Howden it is likely you will be able to cancel your cover and get a refund – please contact the Howden team to discuss.

For day to day activity yes, but not for large events.

The risk of transmission of coronavirus is a risk to be managed like any other, such as the risk of someone falling down steps and breaking their leg.

Therefore, you should have appropriate measures in place to manage the risk of virus transmission, such as enforcing social distancing and good hygiene and you should record your efforts in a risk assessment. As long as you are doing this, the insurance will protect you if a claim is made by someone alleging they contracted the virus at your premises.

Cover for claims arising from COVID-19 is only excluded if you have more than 50 people in attendance at any one time.

Employers' Liability

Employers' Liability insurance is a defensive policy that protects the club if someone who is working for you is injured and claims compensation from you because they allege their injury was a result of your negligence.

The limit of indemnity is £10m for each and every claim.

No -  there zero excess on ECB policies Employers' Liability claims.  

Yes. Anyone working on behalf of the club, including volunteers, could fall under the Employers' Liability cover.

Directors’ and Officers’ Liability

Directors’ and Officers’ (D&O) cover protects the personal liability of club directors and officers against claims brought against them that allege wrongdoing on their part in the course of their running of the club.

Protection covers club officers and committee members or, if your club is a limited company, your directors, whether they are employees or volunteers. If the club is a registered charity, the policy will protect the charity trustees.

The limit of indemnity is £2m per club, per claim and overall for the policy year.

Cyber and Data Liability

This policy protects the club against claims made against it as a result of a breach of data protection rules and regulations, for example, if your club membership data is lost or stolen. It also provides cover to support clubs if you suffer a cyber-attack, such as a ransomware attack.

The limit of indemnity is £50,000 for any claim in respect of your own losses and investigations.

Cover of up to £10,000 any one claim is included for financial crime, including electronic theft or social engineering fraud (if you inadvertently transfer funds to someone in response to a fraudulent request).

Property and Equipment

No, this cover is something clubs need to arrange individually, as the needs and requirements of each club are different. Howden has created a bespoke cricket clubs’ policy specifically for ECB registered clubs. Find out more here.

Yes, the policy has been developed in consultation with cricket clubs themselves to ensure the cover is specific to your needs.

Coverage includes:

  • loss of use of the pitch
  • damage to grounds keeping equipment
  • loss of licence
  • damage to nets.

For clubs with flood issues, alternative cover can be arranged that is tailored to your unique circumstances.

No, the policy provides cover for loss of income arising from a closure of your club due to certain specific diseases, but like all insurers COIVD-19 is excluded from that list.

Tours

The cover provided through ECB registration will still protect the club when you are playing abroad on tour, but it does not provide cover for emergency medical expenses, should any member of your tour be injured or taken ill. This could also include the costs of bringing an injured person back to the UK.

If your tour is cancelled as a result of a lockdown or travel restrictions being imposed, this is not covered under tours insurance.

Cover is included, however, if a member of your tour needs medical treatment for COVID-19 related illness whilst you are away.
