Employment Practices Liability Insurance (EPL) provides protection for an employer against claims made by employees, former employees, or potential employees. It covers discrimination (age, sex, race, disability, etc.), wrongful termination of employment, sexual harassment, and other employment-related allegations.

EPL is a growing product, particularly in the US where cases against employers are increasing.  It is estimated that in the US 60% of all firms will be sued by an employee at some time and companies are vulnerable from the pre-hiring process through the exit interview, even if the employee was never hired, or only with the company a short time.   However, it is not just the laws and protections in the U.S. that enable people to bring claims.  Elsewhere in the world we have seen ever increasing levels of legislation in favour of employee rights including equal opportunities and rights to work, and laws governing positive discrimination. 

No matter where they are located all employers have to face the fact that the chance of targeted legal action from past, present and prospective employees is a reality. Even if the claim is groundless or fraudulent, the defence of a suit can be expensive, consuming both time and financial resources, and these expenses and eventually settlements can be transferred to the insurance market with an EPL policy.
